Heard Sri Priyam Kumar Singh holding brief of Dr. Surendra Kumar Misra for the petitioner as well as learned Additional Chief Standing counsel on behalf of the respondents.

It has been submitted by learned counsel for the petitioner that husband of the petitioner Devendra Kumar was working on the post of Forest Guard in Uttar Kheri Forest Division and died on 7.9.2022 while on duty. The petitioner being the legal heir of the deceased government servant, moved an application for appointment under Dying in Harness Rules, 1974 on 20.12.2022 before Divisional Forest Officer, North Kheri (Bufferzone), Lakhimpur Kheri i.e. opposite party No.2 which is still pending and no decision on the same has been taken. It is in aforesaid circumstances that a prayer has been made for a direction to opposite party No.2 to consider and decide the application of the petitioner for appointment under Dying in Harness Rules, expeditiously.

Learned Additional Chief Standing counsel does not oppose the prayer of the petitioner.

Accordingly, considering the grievance raised by the petitioner, the petition is disposed of with a direction to opposite party No.2 to consider and decide the application of the petitioner dated 27.12.2022, as contained in Annexure No.1 to the writ petition, expeditiously, say within a period of six weeks from the date a certified copy of this order is placed before him, in accordance with law and communicate the decision to the petitioner.
