Heard the learned counsel for the petitioner, Shri S.K. Khare, learned Standing Counsel for the State, Shri Namit Sharma and Shri Saurabh Gupta, learned counsels for the Nagar Nigam.

By means of the instant writ petition filed under Article 226 of the Constitution of India, the petitioner has prayed for removal of encroachment on a pond land Gata No.91 measuring area 0.5350 hectare situated at VillageMalharmau Kala, Pargana and Tehsil Mohanlalganj, District-Lucknow.

Shri Namit Sharma, learned counsel for the Nagar Nigam submitted that as per the I.G.R.S. annexed with the writ petition, proceedings for demarcation of the aforesaid land have already been initiated and it has been reported on I.G.R.S. portal that as soon as police force is available, encroachment will be removed in presence of the team of officials of Revenue Department.

Learned Standing Counsel submitted that as proceedings of general elections are going on, there is some scarcity of police force presently and as soon as police force will be available, the same will be provided for assistance to the officials of Nagar Nigam and Revenue Department for removal of the encroachment.

Keeping in view the aforesaid facts and circumstances of the case, the instant writ petition is disposed of with a direction to all the respondents to ensure a coordinate action for removal of enchroachment on a pond land Gata No.91 measuring area 0.5350 hectare situated at Village-Malharmau Kala, Pargana and Tehsil Mohanlalganj, District-Lucknow by 30.06.2024.
