- The present application has been filed by the applicant seeking transfer of Case No.227 of 2018 under Section 128 Cr.P.C. pending before the court of Additional Principal Family Judge, Jaunpur, District- Jaunpur to the competent Court of Principal Judge, Varanasi.
- Learned counsel for the applicant during course of hearing has drawn attention of this Court to the fact that in an Application U/S 482 Cr.P.C. No. 27153 of 2019 vide order 15.7.2019 and subsequently in an Application U/S 482 Cr.P.C. No. 17605 of 2020 vide order dated 19.2.2021 the trial Court was issued a direction by this Court to dispose of the case in hand expeditiously without granting any unnecessary adjournment to the parties.
- From the perusal of the order sheets, the copies of which are appended with the affidavit, it reflects that the trial Court has made sincere efforts to comply with the orders passed by this Court and proceedings for attachments etc. have been initiated against the opposite party no.1/ husband but the fact remains the same that the total outstanding amount due to the opposite party no.1 has not been paid to the applicant so far.
