Sri Lakshmi Kant Pandey, learned counsel for applicant and Sri Kunwar Tejandra Bahadur, learned AGA are present.

The instant transfer application has been filed by the applicant with a prayer to transfer the Case No. 227 of 2018 (Anju Vs. Santosh), under Section 128 Cr.P.C. pending in the court of Additional Principal Family Judge, Jaunpur to the court of Principal Judge, Family Court, Varanasi.

At the very outset, learned counsel for applicant submits, applicant is wife of opposite party no.1 and she filed instant transfer application to transfer the case from District Jaunpur to District Varanasi but applicant is ready to pursue the matter through Video Conferencing and therefore instant application may be disposed off with the direction that if applicant filed an application before appropriate forum to appear through Video Conferencing then her application shall be entertained and she will be permitted to appear through Video Conferencing.

Learned AGA is having no objection.

The instant transfer application has been filed by the applicant, who is wife to transfer the proceedings of the case from District Jaunpur to District Varanasi but now she is ready to appear through Video Conferencing, therefore, instant transfer application is disposed off with a direction that if applicant filed an application to appear through Video Conferencing then her application shall be considered and she will be permitted to appear through Video Conferencing.
