Shri Akshat Srivastava, Advocate holding brief of Shri Ashok Kumar Singh Tomar, learned counsel for the applicant has submitted that the present application under Section 24 C.P.C. has been preferred by the applicant for transfer of Case No. 596 of 2022 (Shubham Kumar Chauhan Vs. Smt. Manorima) filed under Section 9 of the Hindu Marriage Act, 1955 by the respondent-husband before the Principal Judge, Family Court, Gonda to the Principal Judge, Family Court, Lucknow.

Learned Counsel for the applicant has submitted that applicant has filed one case under Section 125 Cr.P.C. and another case under Section 12 of the Protection of Women from Domestic Violence Act, 2005 against the respondent-husband in Lucknow. In these cases, Court has directed to pay Rs. 3,500/and Rs. 5,000/- per month to the applicant respectively, whereas the orders are not being complied with by the respondenthusband.

It is further submitted that applicant is living with her old aged parents and it is very difficult for her to travel 120 Kms from Lucknow to Gonda one side particularly when she had no source of income as she is unemployed.
