Sri Mahesh Chandra Shukla, learned counsel for the appellants prays for adjournment to enable him to prepare and argue because he is not having the complete paper book and the documents with him are not readable.
The request is vehemently opposed by Sri Lakshmana Singh. He submitted that on the undertaking of learned counsel for the appellant that he will argue on the next date, the appeal was restored on the last date.
This appeal was restored by means of the order dated 22.12.2024 and undertaking of learned counsel for the appellant was recorded that he will argue this matter on the next date.
Despite repeated asking to argue in view of undertaking given by him, learned counsel for the appellant shows his inability to argue and does not argue.
In regard to the submission of learned counsel for the appellants that he is not having the complete paper book is not expected and tenable once he has given an undertaking that he will argue on the next date, that too about three weeks back.
In view of above, the appeal is dismissed for non prosecution.
Interim order, if any, stands vacated.
