Shri Vishwanath Pratap Singh, learned counsel for the appellants has sent illness slip.
This Court by means of the order dated 12.03.2024 while fixing the case for hearing today i.e. 02.04.2024 has recorded undertaking of learned counsel for the appellant Shri Amrendra Singh that he will not seek adjournment on future dates in this matter.
Shri M.E. Khan and Vishwanath Pratap Singh, Advocates have filed Vakalatnama on behalf of the appellants as per office report dated 19.03.2024. The Vakalatnama has been filed with no objection of Shri Amrendra Singh, Advocate that he has no objection in additional advocate with him.
Despite the aforesaid undertaking given by Shri Amrendra Singh, Advocate the adjournment has been sought by one of the subsequent counsel, however there is no request on behalf of Shri Amrendra Singh, Advocate and Shri M.E. Khan, Advocate who has filed power with Shri Vishwanath Pratap Singh, Advocate.
In view of above, it is apparent that the appellants does not want to pursue this appeal of 1998 and wants to get it linger on for one or the other reason even after giving undertaking by the counsel for the appellants.
Once an undertaking has been given by an advocate that he will not seek adjournment on future dates in the matter, the seeking of adjournment even by the counsel who has filed power additionally is nothing but violation of undertaking given before the Court. Even Otherwise there is no request for adjournment or pass over by other counsels.
In view of above, the appeal is, dismissed for want of prosecution.
Interim order, if any, is hereby vacated.
