Head Mr. Vijay Pratap Singh, learned counsel for the revisionists and learned Additional Government Advocate for the State.
The order dated 01.01.2024 passed by Additional District and Sessions Judge/ Fast Track Court No.1, Muzaffar Nagar in S.T. No. 2354 of 2023 (State Vs. Atul Kumar and others), arising out of Case Crime No. 97 of 2023, under Sections 498A, 323, 504, 304B I.P.C. and Section 3/4 of Dowry Prohibition Act, Police Station Purkaji, District Muzaffar Nagar, whereby discharge application of the revisionists has been rejected, is under challenge.
On 23.07.2024 following order was passed by this Court:
"By means of the instant criminal revision, the order dated 01.01.2024 whereby discharge application of the revisionists has been rejected, is under challenge.
On the matter being taken up, learned A.G.A. pointed out that 08.01.2024 was the date fixed for framing of charges against the revisionists.
However, learned counsel for the revisionists submits that till date, charges have not been framed against the revisionists.
Let a report be called for from the concerned Presiding Officer with regard to present status of trial of the revisionists by the next date.
Put up this case as fresh on 14.08.2024 along with the report."
Pursuant to aforesaid order dated 23.07.2024, trial court has submitted report dated 12.08.2024, which is on record mentioning inter alia that charges have
been framed against the revisionists on 08.01.2024 and process has been issued for summoning the prosecution witnesses.
In response, learned counsel for the revisionists upon instructions submits that the revisionists do not want to press this criminal revision, therefore, the same may be dismissed as not pressed.
Learned Additional Government Advocate has no objection to such prayer of the revisionists.
In view of the statement made by learned counsel for the revisionists at the Bar, the instant criminal revision is dismissed as not pressed.
