It is argued by learned counsel for the appellant that with regard to the alleged incident dated 22.11.2015, first information report has been lodged after about two years on 04.11.2017 through an application under Section 156(3) Cr.P.C. for the alleged offence under Sections 147, 323, 504, 506, 452 IPC and Section 3(1)(Da) SC/ST Act against five accused persons, namely, Harish Chandra, Nagendra (present appellant), Akhilesh @ Pappu, Lobhi and Surendra making allegation of assault to him, Avinash and Mudrika by lathi, danda and knife against the accused persons whereas the informant has received only one injury in the nature of incised wound 1 cm x 0.1 cm at the muscle area of palmar aspect of the left palm. It is also pointed out that it has not been specified by the prosecution that out of five accused persons, who has caused the said injury. The appellant has been falsely implicated in the present case on account of property dispute because earlier the sale deed of the property in question was executed by the vendor in favour of wife of co-accused Harish Chandra and later on, the said property has been purchased by sister-in-law of the son of the complainant/opposite party no. 2. It is also submitted that from the side of the appellant, a suit for cancellation of the sale deed has also been filed.
