The present contempt application has been filed for noncompliance of judgement and order dated 26.09.2023.

Learned counsel for the respondent has filed compliance affidavit enclosing therein that in compliance of the judgement and order of the writ court, payment has already been made to the applicant.

Learned counsel for the applicant has raised an objection that no interest of delayed payment has been paid to the applicant, which was also directed by the writ court by its judgement and order dated 26.09.2023 and on the request of learned counsel for the respondent, two weeks time was granted to ensure the payment of admissible interest to the applicant on delayed payment.

In compliance thereof, an affidavit of compliance has been filed by Shri Ravi Ranjan, Managing Director, U.P. State AgroIndustrial Corporation Limited i.e. respondent no.1 enclosing therein the details of interest paid on delayed payment to the applicant @ 8% per annum, which is opposed by learned counsel for the applicant that the applicant is entitled @ 10% interest not @8%.

In reply thereto, learned counsel for the respondent has submitted that as per Section 7(3-A) of the Payment of Gratuity Act, 1972 delayed payment of gratuity, the interest not exceeding the rate notified by the Central Government from time to time for repayment of long term deposit is provided and accordingly @8% interest has been given to the applicant.

In view of above, judgement and order of the writ court has been complied with.

In case the applicant still feels aggrieved regarding rate of interest, he may avail the remedy as may be permissible under the law.

As such the present contempt application is dismissed .

¶14

The notice issued against the respondent is hereby discharged.
