(1) By means of the instant Criminal appeal, a challenge has been made to the judgment and order dated 04.10.2024 passed by the learned Additional District & Session Judge/F.T.C. (NEW), Lakhimpur Kheri, in Sessions Trial No.712 of 2009, arising out of Case Crime No.784 of 2008, registered in Police Station Mohammadi, District Kheri, under Sections 328, 342, 352, 376, 392, 506 of the I.P.C. whereby the privaterespondents nos.2, 3, 4 and 5 namely Mobin, Kasim, Rasid and Nafees respectively, are acquitted of all the charges levelled against them.

(2) This Appeal was filed under Section 372 of the Cr.P.C. [Now 419 B.N.S.S.] by the victim.

(3) Learned A.G.A. has accepted notice on behalf of the State, Opposite party no.1.

(4) Admit.

(5) Let Trial Court's Record be summoned.

(6) Issue Bailable Warrant of Rs.15,000/- against the private-respondents nos.2, 3, 4 and 5 namely Mobin, Kasim, Rasid and Nafees respectively, to be served through the Chief Judicial Magistrate, concerned. If they are arrested or surrender before the court concerned, they shall be enlarged on bail, on their furnishing personal bonds and two sureties each in the like amount, on the undertaking that they shall appear before this Court through their counsel or in person on the next date of listing.

(7) The C.J.M., concerned shall ensure that at the time of accepting bail bonds, an authenticated copy of the Current address/ I.D. Proof of the respondents be taken on record alongwith the photocopy of the bail bonds.
