Heard Sri Rakesh Pati Tiwari, learned counsel for the applicant, Sri Ajai Kumar, learned counsel for the opposite party no.2 and Sri Bade Lal Bind, learned counsel for the State and perused the material on record.

This application under Section 482 Cr.P.C. has been filed by the applicant- Vikas alias Vivek Kumar Sharma, with the prayer to allow this application and quash the entire proceeding as well as impugned order dated 16.02.2024 in Session Trial No. 396 of 2017 (State Vs. Pooja and others) arising out of Case Crime No. 115 of 2016, under Section 306 I.P.C., Police Station Faridpur, District Bareilly, pending in the court of Additional Session Judge, Court No.1, Bareilly, with a further prayer that proceedings of the aforesaid case be stayed during the pendency of the present application. It is also prayed that the trial court be directed to connect the Complaint Case No. 790 of 2019 (Kallu Sharma vs. Bramhaswaroop Sharma), under Section 306 I.P.C., Police Station Faridpur, District Bareilly, pending in the court of Judicial Magistrate, Faridpur, Bareilly.

After some arguments, learned counsel for the applicant states that the trial in the present matter is at the verge of completion and is at the stage of recording of statement of the accused u/s 313 Cr.P.C. It is submitted that the present application under Section 482 Cr.P.C. be dismissed as withdrawn as he intends to file a better petition.

As prayed, the present application under Section 482 Cr.P.C. is dismissed as withdrawn.
