Heard Shri Abhinab Mishra, learned counsel for the applicant and Sri Pusp Raj Singh, brief holder for the State.
The present 482 Cr.P.C. application has been filed to quash the entire proceedings of Case No. 150 of 2022 (State Vs. Juvenile and other) arising out of Case Crime No. 155 of 2022, under Sections 323, 504, 506 of I.P.C., Police Station- Sheeshgarh, District Bareilly, as well as cognizance/summoning order dated 23.09.2022 pending in the court of Juvenile Justice Board, Bareilly.
Learned counsel for the applicant submits that the present application has been filed by the applicant through his guardian (father).
Learned counsel for the applicant fairly admits that no application to declare Juvenile has been pending before the Juvenile Justice Board, Bareilly and wants opportunity to file an application to declare Juvenile before the Juvenile Justice Board, Bareilly.
After some arguments, learned counsel for the applicant does not want to press this application and wants liberty to file an appropriate application/ proceedings before the court of competent jurisdiction.
Certified copy of the order may be returned to the learned counsel for the applicant after retaining a xerox thereof.
In view of the above, the application is dismissed as not pressed with the aforesaid liberty.
