Sri Ashish Srivastava, learned counsel for the applicants, Sri Dharmendra Kumar, learned counsel for the opposite party no. 2 and Sri R.K. Singh, learned A.G.A. for the State are present.
The present application under Section 482 of the Code of Criminal Procedure, 1973 has been filed to quash the entire proceedings of Case No. 685 of 2024, (State Vs. Pratap Singh and others) arising out of Case Crime No. 641 of 2023, under Sections 147, 148, 452, 323, 504, 506, 336 of I.P.C., Police Station- Tilhar, DistrictShahjahanpur, as well as cognizance/ summoning order dated 15.02.2024 pending in the Court of Judicial Magistrate, Tilhar, Shahjahanpur.
After some arguments, learned counsel for the applicants does not want to press this application and wants liberty to file an appropriate application/ discharge application/proceedings before the court of competent jurisdiction.
Certified copy of the order may be returned to the learned counsel for the applicants after retaining a xerox thereof.
In view of the above, the application is dismissed as not pressed with the aforesaid liberty.
