Heard learned counsel for the petitioner. Notice on behalf of respondent no. 1 has been accepted by the office of the learned Chief Standing Counsel.

In view of the order proposed by the Court, notice to the private respondent nos. 2 to 8 is dispensed with.

A copy of the written instructions dated 11.12.2024 has been provided to the Court for perusal which is taken on record.

The said written instructions are under the signatures of Devi Patan Mandal, Gonda and in paragraph 3, it has been indicated several letters have been sent for summoning of the records yet the same is not available, hence, the revision could not be decided.

Be that as it may, the fact remains that the Additional Commissioner concerned who is seized of the revision was required to ensure that the record is available.Merely to state that several letters have been sent to a subordinate authority for sending the record which is not available does not inspire confidence nor does it reflect the bonafides of the respondent no. 1.

Considering the fact that the hearing of the revision is hampered on account of the non-production of the records, accordingly, this Court without entering into the merits directs the respondent no. 1 to ensure that the record is made available with him within the next two weeks and in case if the record is not summoned, he shall take administrative action against the Authorities who are not complying with the orders and he shall ensure that the revision is decided as expeditiously as possible after affording full opportunity of hearing to the parties but without granting any unnecessary adjournments to either of the parties.

With the aforesaid observations, the petition shall stands disposed of.

It is made clear that the Court has not examined the case of either of the parties and the Authority concerned shall decide the same strictly in accordance with law.
