The respondent has filed compliance affidavit alongwith the application for discharge of the contempt notice, which is taken on record.

Learned counsel for the respondent has submitted that in compliance of the judgement and order dated 8.12.2023 passed in Writ-A No.9367 of 2023 on the represent of the applicant / petitioner, after providing an opportunity of hearing to the applicant/ petitioner the refixation has been made and the recovered amount of Rs.6,04,199/- has been credited in the account of the applicant, the copy of the documents have been enclosed as Annexure No.4 to the compliance affidavit.

Learned counsel for the applicant has submitted that the refixation has not been made in compliance of the order of this Court and after arguing at some length, he has submitted that the order / judgement dated 8.12.2024 has been complied with, so the present contempt application has become infructuous and prayed that the same may be dismissed as infructuous with liberty to the applicant / petitioner that if he has any grievance, he may file writ petition.

As prayed by learned counsel for the applicant/ petitioner, the present contempt application/ petition is dismissed as infructuous. The notice issued against the respondent is hereby discharged.

The applicant is at liberty to challenge the same as may be permissible under the law.
