Shri R.M. Upadhyay, learned Standing counsel for the State respondent is present.
Learned Standing counsel submits that the entire dispute is with regard to some drainage, wherein, the application of the petitioner was entertained and registered bearing No. 16206180032869 and cognizance has also been taken by the lekhpal / respondent no. 7, and consequently, report in this regard has also been submitted indicating therein that the petitioner is not interested for construction of drainage on the spot, but inclined to continue the dispute so that matter always be alive. He further submits that similar reports dated 001.02.2018 and 12.02.2018 have also been submitted later on, which are annexed as Annexure No. 16 to the writ petition. He submits that if the petitioner has any grievance he may approach the competent authority, writ under Article 226 of the Constitution of India is not an efficacious remedy.
Considering the facts and circumstances of the case, we are not inclined to entertained the writ petition as has been framed and drawn, the writ petition is accordingly, dismissed.
Needless to say, it is always open to the petitioner to invoke the remedy before the competent authority.
