Heard learned counsel for the petitioner; learned Standing Counsel for the State-respondent and Sri Radhey Shyam, learned counsel for the respondent no. 3 and 4.

Petitioner is before this Court with a prayer to direct the learned District Consumer Forum, Allahabad to expedite the proceedings in Complaint No. 238 of 2016, (Aashish Kumar Vs. National Insurance Company and another) within stipulated time.

We have the occasion to peruse the record in question and what we find that the petitioner has admittedly moved the complaint in the year 2016 and admittedly, we are totally unaware of the roster and catalogue that is maintained at counsumer court and in what way and manner the consumer court is working, as such we cannot give direction to decide the complaint within the stipulated time frame, but certainly we make it clear that no unnecessarily adjournment shall be granted in the case except upon payment of cost of Rs. 50/- and all endeavour should be made to decide the case expeditiously, subject to cooperation of parties as well as convenience/roster of the trial court.

With the aforesaid observations, present writ petition is disposed of .
