The present petition has been filed primarily seeking to raise a grievance with regard to the fact that certain hindrances are being caused in the possession of the petitioner over land which the petitioner claims to be his own. A representation in this regard is stated to have been submitted before the respondent no. 2.
Counsel for the State respondents submits that as per instructions received, the petitioner had initiated proceedings under Section 24 of the U.P. Revenue Code, 2006 (Case No. 3082 of 2022), in respect of the land in question, which was dismissed for non-prosecution on 27.07.2022 and accordingly, in the absence of any proper demarcation, the reliefs as sought in the writ petition cannot be accorded consideration.
Counsel for the petitioner on the basis of his instructions received submits that an application seeking recall of the aforestated order dated 27.07.2022 has been moved by the petitioner on 27.02.2023. Learned counsel submits that in view of the aforestated developments, he does not wish to press the petition and that the petitioner would pursue his remedy before the concerned respondent where the matter is stated to be pending.
The petition stands disposed of accordingly.
