1. Shri Ravesh Kumar Singh, learned counsel for the petitioner, Shri P. K. Chauhan, learned Standing Counsel for the Staterespondents. Shri Krishna Kant Singh, learned counsel has accepted notice on behalf of respondent No. 5.

2. Considering the nature of the order that is proposed to be passed, service of notice upon respondent No. 4 is being dispensed with.

It is contended by learned counsel for the petitioner that on some complaint lodged against the respondent No. 4, on an inquiry being held, prima facie, the allegations against the respondent No. 4 were found to be correct vide order dated 25.6.2022 passed by the District Panchayat Raj Adhikari, Etah. Thereafter pursuant to the preliminary enquiry, various orders were passed, but till date no concrete steps have been taken against the respondent No. 4.

Counsel for the petitioner submits that purpose of filing this writ petition would be served if directions are issued to the respondent No. 2-District Magistrate, Etah to pass appropriate orders on the pending representation dated 26.7.2023 of the petitioner within a time frame fixed by this Court.

5. Learned Standing Counsel submits that he has no objection to the aforesaid proposition.

Considering the submissions advanced, this Court is of the opinion that no useful purpose would be served by keeping the writ petition pending and the same is accordingly, disposed of requiring the respondent No. 2, District Magistrate, Etah, seized with the representation of the petitioner dated 26.7.2023, to pass appropriate orders thereon, after considering all aspects of the matter, expeditiously preferably within a period of 45 days from

the date of service of a certified copy of the order of this Court.

7. Needless to say that this Court has not expressed any opinion on the merits of the case and it shall be open for the respondent No. 2 to pass appropriate orders, strictly in accordance with law, .
