Heard learned counsel for the petitioner and learned Standing Counsel for the respondents no.1 to 3.

It is argued by counsel for the petitioner that pursuant to Clause 9 of the Government Order dated 19.10.2022, a representation was submitted by the petitioner before the District Magistrate, Ghazipur and District Inspector of Schools, Ghazipur. It is argued that the petitioner has already sent a e-mail to the concerned competent authority on 29.12.2022 on the address given in the notification itself, copy of the aforesaid e-mail placed before the court and the same is taken on record. It is further argued that though the aforesaid representation was submitted as per policy of the respondents themselves before the cut of date but till date no decision has been taken. It is further argued that matter is extremely urgent since examinations are going to be held from 3rd week of February, 2023.

On the other hand it is argued by learned Standing Counsel that in case, the petitioner will file fresh representation before respondent no.2/Madhyamic Shiksha Parisahd U.P. at Allahabad along with necessary documents and papers including receipt of email, the respondent No.2 will pass appropriate orders within two weeks.

In the facts and circumstances of the case, the present writ petition is disposed of directing the petitioner to file fresh

representation before respondent no.2/Madhyamic Shiksha Parisahd U.P. at Allahabad along with necessary documents and papers including receipt of email and a copy of this order within a period of one week from today. If the petitioner will file fresh representation within stipulated period, the respondent No.2 will pass appropriate orders on the same within a period of one week thereafter strictly in accordance with law. If the decision has already been taken on the application dated 29.12.2022, copy of the same be communicated by the respondent no.2 to the petitioners within the same period.
