Heard learned counsel for the petitioners and learned Standing Counsel for the respondents no.1 to 4.
It is argued by counsel for the petitioners that pursuant to Clause 9 of the Government Order dated 19.10.2022, a representation was submitted by the petitioners before the respondent no.2-Secretary, Madhyamik Shiksha Parishad, U.P. at Prayagraj on 29.12.2022 and forwarded the same through email, copies of which is appended at page 37-38 of the paper book. It is further argued that though the aforesaid representation was submitted as per policy of the respondents themselves before the cut of date but till date no decision has been taken. It is further argued that matter is extremely urgent since examinations are going to be held from 3rd week of February, 2023.
On the other hand it is argued by Mr. Vivek Rai, learned Additional Chief Standing Counsel that respondent no.2 will pass appropriate orders within two weeks.
In view of the statement made by learned Additional Chief Standing Counsel, without expressing any opinion on the merits of the issue, the present petition stands disposed of finally with a direction to the petitioners to serve copy of this order before the respondent no.2 within a period of one week from today. If it is so respondent no.2 is directed to pass appropriate orders on
the aforesaid representation of the petitioner within a period of ten days, thereafter. If the decision has already been taken, copy of the same be communicated by the respondent no.2 to the petitioners within the same period.
