Heard learned counsel for the petitioner and the learned Standing Counsel for the Staterespondents.
By means of the instant petition, the petitioner seeks the following reliefs which reads as under:-
"(i) Issue a writ order or direction in the nature of certiorari to quash the impugned order dated 30.09.2022 passed by Executive Engineer Provisional Division P.W.D. Balia.
(ii) Issue any suitable writ, order or direction in the nature of mandamus to impugned order dated 30.09.2022 passed Executive Engineer Provisional Division P.W.D. Balia."
The record indicates that on 07.12.2022, learned Standing Counsel was directed to seek instructions as to why the amount has not been paid to the petitioner despite an order dated 30.09.2022 indicating that the petitioner is entitled to the said amount.
Again on 07.02.2023, learned Standing Counsel was granted time to seek updated instructions and in furtherance thereof, a copy of the written instructions dated 10.02.2023 have been provided to the Court which is taken on record.
Learned counsel for the petitioner has also filed a supplementary-afÏdavit which is also taken on record wherein he has stated in paragraphs no.3 to 5 that he has received the amount as admissible to him except the amount for Group Insurance Scheme.
In this regard, learned Standing Counsel has submitted that even the formalities for payment of
group insurance has been completed and the same shall be paid very soon.
Considering the aforesaid stand, this Court is not inclined to keep the matter pending and the petition is being disposed of with a direction that the State shall also take all necessary measures for expeditious payment of group insurance as payable to the petitioner preferably within a period of three weeks, from the date a copy of this order is placed before the Authority concerned.
With the aforesaid, the petition is disposed of.
