Heard learned counsel for the petitioner. Sri Vikram Bahadur Yadav, learned Standing Counsel for the State-respondents as well as Sri Gaurav Kumar Chand, learned counsel for the Union of India.

The issue in question relates to the post retiral dues of the petitioner. The petitioner seeks a direction in the nature of mandamus commanding the respondents to take appropriate action in the matter of grant of aforesaid family pension.

This Court by means of order dated 19.01.2023 had required the learned counsel for the petitioner to provide the complete copy of the writ petition to the learned Standing Counsel for the State to enable him to complete his instructions and in furtherance thereof the written instructions have been provided to the Court dated 23.01.2023 which is taken on record.

The stand of the learned Standing Counsel for the State is that the petitioner was informed by means of letter dated 18.05.2022 to complete certain formalities in pursuance whereof appropriate decision as well needful for the grant of family pension would be considered.

It has been submitted that till date the petitioner has not complied with nor has been provided the documents as sought by him.

At this stage, in view of the stand taken by the State Government, this Court is not inclined to keep the matter pending, accordingly, this Court directs that the petitioner within a period of two weeks from today to appear before the office of the respondent no. 4 and in furtherance thereof the letter dated 18.05.2022 shall complete all the formalities as required. Upon doing so, the respondent no. 4 shall process the aforesaid papers and ensure that all the needful is done so that the family pension etc. can be released in favour of the petitioner within a further period of four weeks thereafter from

the date, a certified copy of this order is placed before the Authority concerned.

It is made clear that the Court has not examined the case of the petitioner on merits and the Authority concerned shall decide the same strictly in accordance with law.

With the aforesaid, the petition stands disposed of.

In the meantime, the learned Standing Counsel is directed to provide copy of the written instructions including the letters dated 18.05.2022 and 27.04.2022 to the learned counsel for the petitioner.
