On instructions received, Mr. M.N. Mishra, learned Counsel for respondent no. 3 has produced before this Court copy of a resolution of the Sadhan Sahkari Samiti Limited, Jalalpur, Vikas Khand-Shikarpur, District-Bulandshahr dated 27.08.2023, which shows that the petitioner's dearness allowance for the month of August, 2023 have been released at the rate of 412 %. He states that in future dearness allowance shall be paid to the petitioner at this enhanced rate. In view of the said undertaking a direction is issued to the respondents to pay dearness allowance at the said rate.
In view of the said stand of respondent no. 3 and the order made, both parties agree that no further orders are required to be passed. Mr. Roopesh Tiwari, learned Standing Counsel has appeared for respondent nos. 1 and 2, who has no objection to this petition being disposed of.
This writ petition is disposed of in terms of the aforesaid orders with liberty that if, in future, payment of dearness allowance at the enhanced rate is withheld, the petitioner will be at liberty to move a fresh writ petition.
