In compliance with the order dated 17.08.2023 passed on the interim mandamus application, a short counter affidavit has been filed on behalf of respondent No. 4. It it taken on record. Let it be numbered by the office.

In paragraph No. 10 of the affidavit, it is averred :

That it is pertinent to mention here, in Compliance of the Order dated 17/08/2023 passed by this Hon'ble Court ,the claim of master policy no 52689 of the petitioner , under the head of Group Insurance Scheme, credited amount Rs 48553/- in account number 8480201000051, Canara Bank on 16/08/2023 of the petitioner by Respondent No. 4 and also informed to Varisth Lekha Adhikari Bima Uttar Pradesh Jal Nigam, 6 Rana Pratap Marg , Lucknow by letter Reference No. PNGS/52689/1811, dated 16.08.2023. A True/ Photo state copy of detail letter reference no. PNGS/52689/1811, dated 16/08/2023 is annexed here with and marked as Annexure No. 1 to this affidavit .

A perusal of the order dated 17.08.2023 shows that the post retiral benefits due to the petitioner under other heads have already been paid, mostly on 17.08.2023, aggregating a sum of Rs. 19,09,599/-.

In view of the fact that group insurance too has been paid to the petitioner through R.T.G.S. in his bank account, no further orders are required to be made on this

petition.

At this stage, learned Counsel for the petitioner states that the petitioner may be granted liberty to agitate his claim as regards arrears under the Sixth Pay Commission, currently under consideration, but not being paid.

This writ petition stands disposed of , with liberty to the petitioner to agitate his claim relating to arrears in terms of the Sixth Pay Commission as and when the cause of action for the purpose arises.
