Heard learned counsel for the applicant and learned A.G.A. for the State.
This Application under Section 483 Cr.P.C. has been filed by the applicant with a prayer to direct the court below to hear and decide the Complaint Case No. 2724 of 2021 under Sections 498-A, 323, 504, 506 IPC and 3/4 D.P. Act, P.S. Narval, District Kanpur Nagar pending before Additional Civil Judge (J.D.), court no. 2, Kanpur Nagar expeditiously within stipulated time.
Learned counsel for the applicant states that present case was registered as complaint case through an application u/s 156(3) Cr.P.C.; accused were summoned on 8.9.2022, however, presence of the accused persons could not be ensured, which is delaying the trial of the case, hence, a direction may be issued to the court below to the decide the same expeditiously.
It is directed that court below shall make all endeavour to ensure the presence of the accused persons and decide the above case expeditiously preferably within a period of one year from the date of production of certified copy of the order, without permitting undue adjournments to either side, if there is no legal impediment.
With this direction, this application is disposed of.
