This Application under Section 483 Cr.P.C. has been filed by the applicant with a prayer to direct the court below to hear and decide the Criminal Case No. 3706 of 2020 arising out of Case Crime no. 42 of 2019, under Sections 354(Gha), 506 IPC, P.S. Unj, District Bhadohi pending before Judicial Magistrate-II, Bhadohi (Gyanpur) expeditiously within stipulated time.
Learned counsel for the applicant states that chargesheet was filed in the case on 9.10.2020; cognizance was taken by the court; cross examination of PW-1 is continuing and accused side is not cooperating in concluding the cross examination of PW-1, hence, a direction may be issued to the court below to the decide the same expeditiously.
It is directed that court below shall make all endeavour to decide this case expeditiously preferably within a period of six months from the date of production of certified copy of the order, without permitting undue adjournments to either side, if there is no legal impediment.
With this direction, this application is disposed of.
