Heard learned counsel for the applicant and learned A.G.A. for the State and perused the material on record.
Instant Criminal Misc. Application under Section 483 Cr.P.C. has been filed by the applicant who is accused in S.T. No. 1166 of 2016 (State of U.P. Vs. Amanpreet Singh) arising out of Case Crime No. 749 of 2014 under Sections 354, 406, 420, 468, 469, 471, 506, 376 I.P.C. and Section 66 of I.T. Act, P.S.Indrapuram, District- Ghaziabad, which is pending in the Court of learned Special Judge/ POCSO Court No. 1, Ghaziabad, with prayer to issue direction to decide the case expeditiously and within a stipulated period as fixed by this Court.
Learned counsel for the applicant submitted that the case is fixed for evidence since 18.01.2017 and presently, the case is fixed for cross-examination of P.W.-1. Therefore, the applicant is suffering due to protracted trial.
The court concerned is directed to proceed with the case and make every efforts to conclude the trial as expeditiously as possible without granting any unnecessary or long adjournments to either of the parties, preferably within a period of one year from the date of production of a certified copy of this order, if there is no legal impediment.
Accordingly, the application stands disposed of.
