This petition has been filed seeking the following relief:
"I) Issue, a suitable order or direction to set aside the order dated 22.12.2022 passed by the Additional District Judge, Court No.05, Varanasi in Ex. Case No. 47 of 2014, Ashok Kumar Srivastava Vs. Santa Chatterjee and others, (Vide Annexure No. 12 to the petition), with all it's consequential effects."
At the outset, learned counsel for the petitioner seeks leave of the Court to withdraw this petition with liberty to file a fresh petition after enclosing the certified copy of the Paper No. 38 Ga and other relevant documents.
This petition is, accordingly, dismissed as withdrawn with liberty aforesaid provided the petitioner file the fresh petition within a period of 10 days.
The certified copy of the documents on record shall be returned to the counsel for the petitioner as per rules after retaining photocopies of the same.
