Heard Sri Diptiman Singh, learned counsel for the petitioner and Sri Ravindra Singh, learned counsel for the respondent no. 2 and learned Standing Counsel for respondent nos. 1 and 3.

With the consent of the parties the present petition is being decided.

The limited challenge raised in this writ petition was to the change of the nomination of the occupier of the company/unit which order passed by the District Magistrate was stayed by the High Court on 29.01.2009.

The aforesaid nomination was relevant only for the purposes of the payment of the year 2007-2008 and 2008-2009.

Much water has flown thereafter, inasmuch as, all payments have been released or otherwise subjected to further proceedings through judicial intervention by this Court. In the aforesaid circumstances, the entire exercise in so far as the payment is concern which is not even the subject matter of the writ petition has become otiose. Consequently, the issue of change of nomination does not also survive, inasmuch as, it is informed at the Bar that the nomination of the same person has continued, and we do not find any reason now to keep the matter pending. The nomination which is continuing as on date with fresh securities shall be continued unless any fresh orders are passed.
