The instant petition has been filed praying for a mandamus to respondent no.2 to permit the petitioner to display advertisement on Unipole over his own land.

Sri Kaushalendra Nath Singh, learned counsel appearing on behalf of respondent no. 2 states that predecessor-in-interest of the petitioner had instituted a suit under Section 229-B of the U.P. Z.A. and L.R. Act and the said suit was dismissed as not maintainable. He admits that challenging the said order, Writ-B No. 14324 of 2011 was filed by the predecessor-in-interest of the petitioner and therein, an order of status quo is in operation.

The question of title is admittedly subjudice. Learned counsel for the respondent no. 2 does not dispute that the subject land is in possession of the petitioner. The petitioner has moved an application for being granted license to display advertisement on Unipole over the land in question.

In our opinion, the order of status quo does not prevent the petitioner from moving such an application.

Accordingly, we dispose of the writ petition with direction to respondent no.2 to decide the application of the petitioner dated 14.7.2022 in accordance with law and as per the existing policy relating to grant of license, by means of a speaking order, within eight weeks from the date a true attested copy of the instant order alongwith photocopy of the application is filed.
