The petitioner seeks to assail a notice dated 6.8.2022 issued by District Magistrate, Sambhal convening meeting for consideration of no confidence motion.
We are informed that the Sub Divisional Magistrate, Sambhal issued an office memo dated 22.8.2022 stating that he will be on leave on 23.8.2022, the date fixed for consideration of no confidence motion and therefore, the meeting fixed on that date shall stand adjourned till further orders. The office memo also mentions that the next date for considering no confidence motion shall be intimated to all concerned as per provisions of the U.P. Kshetra Panchayat and Zila Panchayat Adhiniyam, 1961.
Counsel for the parties do not dispute that the meeting fixed for 23.8.2022 was not held.
Consequently, we are of considered opinion that no purpose will be served in examining the issue relating to validity of notice dated 6.8.2022.
The petition is rendered infructuous. It stands disposed of accordingly.
It shall be open to Sri Rajiv Gupta, learned Additional Chief Standing Counsel to send the original record back to the authorities, if the same is still being retained by him.
