The prayer made in the instant petition is for a direction to the Kanpur Development Authority to decide the mutation application of the petitioner in respect of Plot No.985.
The case of the petitioner is that the said plot was recorded in the name of her husband Naman Kumar, who had died on 09.05.2016. The mutation application was filed by the petitioner on 28.10.2017 but has not been disposed of so far.
Shri A.P. Paul, learned counsel appearing for respondent nos.2 and 3 states that the application will be decided within six weeks.
Accordingly, without expressing any opinion on merits of the claim of the petitioner, the instant writ petition is disposed of with direction to the Competent Authority, KDA to decide the mutation application dated 28.10.2017 within six weeks in accordance with law, after due notice and opportunity of hearing to the petitioner and her father-in-law, Shri Ram, who is alleged to have filed civil suit against the petitioner in respect of same property, as well as any other party likely to be affected.
