In the personal affidavit of District Magistrate, Amroha, a categorical stand has been taken that spot inspection of the land in question has been made in the presence of the petitioners herein and the entire exercise was recorded properly.

No objection to the spot inspection report dated 20.9.2022 supplied in the written instructions dated 20.9.2022 and appended with the affidavit of the District Magistrate has been taken by the petitioners. In reply to the personal affidavit of the District Magistrate, rather, it is stated therein that the petitioners are satisfied with the spot inspection report and the Expressway Authority can take possession of the land which has been demarcated in the spot measurement exercise conducted pursuant to the order of this Court.

In the said circumstances, we do not find any good ground to keep the writ petition pending. However, the writ petition is being disposed of with the observation that beyond the area which has been demarcated and subject matter of acquisition, in case some land is utilized, the development authority would be required to conduct proper proceedings to pay compensation to the land holders before taking possession of the same.
