Heard Shri Shailesh Kumar Shukla, learned counsel for the petitioner, Sri Mohd. Shere Ali, learned counsel appearing on behalf of respondent nos. 2 to 3 and learned Standing counsel representing the Staterespondents.

With the consent of learned counsels for the parties, this petition is being heard finally at the admission stage itself.

This petition has been filed praying for direction to the respondents to make payment of death gratuity benefit to the petitioner on account of death of her husband, Mangroo Prasad, on 30.12.2012 while working as Assistant Teacher in Primary School Mahadeva Dubey, Block Pharenda, District Maharajganj.

In view of the judgement of this Court in the case of Renu Gupta Vs. State of U.P. and five others , Writ-A No.14397 of 2019, the petition is allowed.

Respondents are directed to compute the amount payable to the petitioner's husband towards gratuity in terms of the scheme and release the same, maximum within a period of three months from the date of production of certified copy of this order. The petitioner shall also be entitled to interest at the rate of 8% per annum, from the date of filing of the application till the amount is actually disbursed.
