Heard learned counsel for the petitioner and Mr. Chandra Prakash Yadav, learned Standing Counsel for respondents 1 to 5.
By means of this writ petition, the petitioner has prayed for a writ of certiorari quashing impugned removal order dated 24.3.2020, passed by respondent NO.4, appellate order dated 8.9.2020 and revisional order dated 9.12.2020, with a further writ of mandamus directing authorities to reinstate services of the petitioner on the post of Constable GD in RPF and pay him salary along with all the consequential benefits.
A preliminary objection has been raised by learned counsel for respondents that no cause of action has accrued within the territorial jurisdiction of this court, therefore, the writ petition is not maintainable before this Court. It is submitted that the impugned orders have been passed at Assam.
Learned counsel for the petitioner could not dispute these facts.
In view of the above, the writ petition is dismissed for want of territorial jurisdiction, with liberty to the petitioner to approach appropriate forum as per law.
