Heard Mr. Vijay Gautam, learned Senior Advocate, assisted by Ms. Atipriya Gautam, learned counsel for the petitioner and learned Standing Counsel for the State.

By means of this writ petition, the petitioner has prayed for a direction to respondents to revise/recalculate pension of the petitioner, after giving annual increments and benefits of next pay upgradation (Third ACP Grade Pay of Rs.4600) under ACP, after calculating/including training period, on account of completion of 26 years of services and to grant benefit of seventh Pay Commission, in view of relevant G.Os. dated 18.7.2017, 23.12.2016, 26.8.2015, 3.3.2015, 5.11.2014, 17.3.2012 and 21.7.2011, with all consequential benefits with a further direction to authorities to recalculate/revise pension of the petitioner, after calculating/including training period, on account of completion of 26 years of his service and also to grant the benefit of revised pay scale and Seventh Pay Commission in view of relevant G.Os, with all consequential benefits.

Learned counsel for the petitioner, after arguing for some time, submits that it will be suffice if the pending representation of the petitioner is decided by competent authority, to which learned Standing Counsel has no objection.

In view of the above, without entering into merit

of the case, the petition is finally disposed of with liberty to the petitioner to move a fresh representation to respondent No.5 (S.P., Banda) within three weeks from today. In case such a representation is submitted within the aforesaid stipulated time, respondent No.5 shall consider and decide it in accordance with law, by passing a reasoned and speaking order expeditiously and preferably within the next eight weeks.
