Heard learned counsel for the petitioner and learned Standing Counsel for the State.

By means of this writ petition, the petitioner has prayed for quashing of transfer order dated 30.6.2022 passed by respondent No.3 as regards the petitioner.

A further prayer to issue a mandamus directing respondent No.3 to comply transfer policy issued for 2022-23 has also been made.

Learned Standing Counsel on the basis of instructions submits that the relieving order dated 2.7.2022 has already been passed, however, the petitioner is not receiving the same.

Learned counsel for the petitioner, after arguing for some time, submits that petitioner's grievance shall be substantially redressed in case his representation is duly considered and decided by respondent No.2.

In view of the above, without entering into merit of the case, the petition is finally disposed of with liberty to the petitioner to move a fresh representation to respondent No.2 within two weeks from today. In case such a representation is submitted within the aforesaid stipulated time, respondent No.2 shall consider and decide it in accordance with law, by passing a reasoned and speaking order expeditiously and preferably

within the next eight weeks.

While deciding the representation so moved by the petitioner, the transfer policy dated 15.6.2022, particularly para 5(VI) thereof as well as the judgment of Supreme Court in SK Nausad Rahaman and others versus Union of India and others 2022 LiveLaw(SC)266 be taken note of.
