This writ petition has been filed by the petitioner to issue a writ, order or direction in the nature of Mandamus thereby commanding the opp. party no.2 to transfer the investigation of Case Crime no.0042 of 2017, under Sections 386, 504, 506 IPC, P.S. Maharuwa, District Ambedkar Nagar to another police of District Ambedkar Nagar for making free and fair investigation or any other independent agency so that the petitioner could get justice.
It appears that by efflux of time, the instant writ petition has become infructuous.
Accordingly, the present writ petition is dismissed as infructuous .
Interim order, if any, stands vacated.
However, it is open for the petitioner to move an appropriate application within two months from today, if the matter survives.
