List has been revised. No one has appeared on behalf of the appellant to press this appeal, however, learned AGA for the State is present.
Chief Judicial Magistrate, Siddharth Nagar vide his letter dated 26.11.2021 has informed this Court that sole appellant Tulsi had already expired about 15 years back. In verification of his death, statement of Vinod Kumar Srivastava and Sant Ram, both nephews of the deceased-appellant has been recorded. The death certificate issued by Anita, Gram Pradhan has also been annexed. The police report of HC Hare Ram Yadav, Police Station Mohana, District Siddharth Nagar has been annexed.
In view of the above, since the sole appellant had already expired, this criminal appeal is dismissed as abated.
