List has been revised. No one has appeared on behalf of the appellant to press this appeal, however, learned AGA for the State is present.
Chief Judicial Magistrate, Badaun vide his letter dated 24.08.2021 has informed this Court that sole appellant Augarh had already expired on 19.06.2017. In verification of his death, statement of Jaipal Singh and Rakesh Kumar, brother-in-law of deceased-appellant has been recorded. The death certificate issued by Government of Uttar Pradesh has also been annexed. The police report of SI Vikas Puniya, Police Station Jariknagar, District Badaun has been annexed.
In view of the above, since the sole appellant had already expired, this criminal appeal is dismissed as abated.
