Heard learned counsel for the applicants, learned AGA for the State and perused the record.
This application under Section 482 CrPC has been filed by the applicants with the prayer to quash the charge-sheet no.8 of 2021 dated 25.06.2021, cognizance order dated 14.07.2021 and entire proceedings of Case C.B. No. 172 of 2013 (State Vs. Roshan Lal Verma and others), arising out of Case Crime No. 349 of 2012, under Sections 147, 148, 149, 152, 186, 188, 332, 353, 504 IPC and Section 7 of Criminal Law Act Police Station Nigohi/CBCID Bareilly, District Shahjahanpur, pending in the court of learned Special Judge (MP/MLA)/ Additional Sessions Judge, Court No.3, Shahjahanpur.
After some arguments, learned counsel for the applicants has made a statement at the bar that he does not want to press other prayers made in the application and has confined his prayer only to the relief that in case, applicants move an application for bail before the court below, their bail application be considered and disposed of at the earliest.
Per contra, learned AGA has opposed for expeditious disposal of bail application of the applicants.
In view of the above statement, it is directed that if the applicants move an application for bail before the court below within ten days from today, their prayer for bail be considered and decided expeditiously in accordance with law.
For a period of ten days from today, no coercive action be taken against the applicants.
With the aforesaid observations, this application under Section 482 CrPC is finally disposed of.
