Learned counsel for the appellant as well as learned A.G.A. for the State are present.
As per office report dated 07.09.2022 based on the report of C.J.M.-Rampur, the sole appellant-Dal Chand had died. In this connection, learned C.J.M. has annexed alongwith his report, the statements of serving officer S.I.-Surendra Kumar, Pappu son of the appellant-Dal Chand, death certificate issued under the Registration of Births and Deaths Act-1969 and the death certificate issued by the Gram Pradhan.
In above circumstances, it is proved that the sole appellant-Dal Chand had died and, accordingly, the appeal is dismissed as abated.
The bail bond is cancelled and the sureties are discharged.
Let the lower court record, if received in the office of the Court, be returned to the concerned court below.
