Learned counsel for appellant as well as learned A.G.A. for the State are present.
Perusal of office report dated 31.08.2022 shows that as per the report of Chief Judicial Magistrate, Bareilly dated 02.05.2019, the sole appellant, Dinesh Chandra Gupta has died in the year, 2003. Regarding death of the appellant, learned Magistrate has recorded the statements of Serving Officer, son of the appellant and neighbour of the appellant, which are annexed along with the report. The death certificate of the appellant issued by Sabhasad has been annexed along with the report.
In the light of aforesaid, the instant appeal stands dismissed as abated on account of death of sole appellant, Dinesh Chandra Gupta.
The appellant was on bail. His bail bond is cancelled and the sureties are discharged.
