Learned counsel for the applicant submits that as per FIR version on 13th July, 2020 in the morning at about 5.30 am. due to enmity applicant and Dhirendra Pratap Singh by abusing stabbed him and Shivam Singh exhorted them but as per statement of the informant applicant, co-accused Dhirendra Pratap and Shivam beat him by lathi danda and they also assaulted him by weapon. He submits that as per statement of eye witness Savita Devi wife of the injured also reiterated the statement of the injured persons and as per medical report injury has been caused by hard and blunt object. The coaccused Shivam Singh has been granted bail by co-ordinate Bench of this Court vide order dated 27.05.2022 in Criminal Misc. Bail Application No. 20754 of 2022, therefore, the applicant is entitled for bail on the ground of parity. There is no possibility of the applicant of fleeing away from the judicial process or tampering with the witnesses and, in case, the applicant is enlarged on bail, the applicant shall not misuse the liberty of bail. It is next contended that applicant has one criminal history lodged by the injured and in which has been enlarged on bail and he is languishing in jail since 23.03.2022.
