Learned counsel for the applicant submits that as per FIR, Amarpal Singh-JE, Ankit Sharma-T.G.2 and contractual employees Lokendra, Raj Kumar and Gagan went to village Saina, District Simbhaoli to disconnect the electric connection of big defaulters, meanwhile applicant, ten named and tentwelve unnamed accused by abusing committed marpeet with lathi danda and sharp weapon. Amarpal Singh-JE received grievous injuries on his head, departmental documents were snatched and destroyed, mobile was broken and Rs. 2500/from the purse were fallen. Due to committing marpeet becoming unconscious Amarpal Singh and Ankit Sharma fell down on the ground and even then they were beaten by lathi danda and left them in fatal condition. He also submits that as per FIR version injury was caused by sharp weapon but no such injury was found on the body of the injured persons. He next submits that co-accused Matloob and Nabab have been granted bail by a co-ordinate Bench of this Court on 07.06.2022 in Criminal Misc. Application No.20566 of 2022, therefore, applicant is also entitled for bail. He further submits that there is no possibility of the applicant of fleeing away from the judicial process or tampering with the witnesses and, in case, the applicant is enlarged on bail, the applicant shall not misuse the liberty of bail and the applicant is languishing in jail since 24.03.2022.
