Instant petition under Section 482 Cr.P.C. has been preferred by the applicants/petitioners for quashing of the proceedings of charge-sheet no. 11/2021 dated 17.01.2021 in case no. 1997/2021 (State of U.P. vs. Polu @ Virendra and another) arising out of case crime no. 0159 of 2020, under Section 308, 323, 504 IPC, P.S. Khakheru, District Fatehpur pending in the court of ACJM, court no. 1 Fatehpur as well as cognizance order dated 26.02.2021.

After arguing at some length, learned counsel for the applicants/petitioners has submitted that the present petition may be disposed of with a direction that if the applicants surrender and move bail applications before the court below then their bail applications shall be disposed of in view of the law laid down by this Court in the case of Amrawati and another vs. State of U.P. reported in 2004 (57) ALR 290 as well as judgment passed by Hon'ble Apex Court in the case of Lal Kamlendra Pratap Singh vs. State of U.P. reported in 2009 (3) ADJ 322 SC.

In view of the above, it is directed that if the applicants appear and surrender before the court below within three weeks from today and apply for grant of bail, their prayer for bail shall be considered and decided in view of the settled law laid down by this Court in the case of Amrawati and another vs. State of U.P. reported in 2004 (57) ALR 290 as well as judgment passed by Hon'ble Apex Court in the case of Lal Kamlendra Pratap Singh vs. State of U.P. reported in 2009 (3) ADJ 322 SC.

With the aforesaid observation/direction, this petition is disposed of.
