Instant petition under Section 482 Cr.P.C. has been preferred by the applicants/petitioners for quashing of the cognizance order dated11.08.2021 passed by learned Additional Chief Judicial Magistrate, court no. 11, Azamgarh and also for quashing of the charge-sheet dated 26.05.2021 under Sections 323, 504, 147, 148, 506, 308 & 325 IPC, P.S. Kaptanganj, District Azamgarh arising out of case crime no. 0024 of 2021 pending before the learned Additional Chief Judicial Magistrate, court no. 11, Azamgarh.

After arguing at some length, learned counsel for the applicants/petitioners has submitted that the present petition may be disposed of with a direction that if the applicants surrender and move bail applications before the court below then their bail applications shall be disposed of in view of the law laid down by this Court in the case of Amrawati and another vs. State of U.P. reported in 2004 (57) ALR 290 as well as judgment passed by Hon'ble Apex Court in the case of Lal Kamlendra Pratap Singh vs. State of U.P. reported in 2009 (3) ADJ 322 SC.

In view of the above, it is directed that if the applicants appear and surrender before the court below within three weeks from today and apply for grant of bail, their prayer for bail shall be considered and decided in view of the settled law laid down by this Court in the case of Amrawati and another vs. State of U.P. reported in 2004 (57) ALR 290 as well as judgment passed by Hon'ble Apex Court in the case of Lal Kamlendra Pratap Singh vs. State of U.P. reported in 2009 (3) ADJ 322 SC.

With the aforesaid observation/direction, this petition is disposed of.
