Learned counsel for the applicant/petitioner has submitted that the applicant has moved an application under Section 125 Cr.P.C. and a case no. 571 of 2019 has been registered, which is pending before the court of Additional Principal Judge, Family court, Ballia, District Ballia from the last more than two and half years. It is further submitted that due to the pendency of the case relating to maintenance, the applicant is facing hardship as she is suffering from Brain Tumor and is undergoing treatment for the same.
Learned counsel for the applicant/petitioner has confined his prayer to the extent that the court below may be directed to decide the matter within the stipulated time frame, as this Court may deem fit and proper.
Learned AGA has no objection to the aforesaid submission of learned counsel for the applicant/petitioner.
As the petitioner is facing financial hardship and it is the right of the litigant to get speedy justice, and hence it is expected that learned court below shall decide the matter expeditiously without granting any unnecessary adjournment to any of the parties and if any adjournment is sought by either of the parties, some short date may be given.
In view of above, the present petition under Section 482 Cr.P.C. is disposed of finally.
